Terms of Service
Effective date: October 22, 2026
These Terms of Service (“Terms”) govern your access to and use of the Pingstack websites, hosted application, APIs, documentation, integrations, and related services (collectively, the “Service”) operated by Atomic Van, LLC (“Atomic Van,” “we,” “us,” or “our”).
By accessing or using the Service, creating an account, or accepting these Terms on behalf of an organization, you agree to these Terms. If you accept these Terms for an organization, you represent that you have authority to bind that organization.
1. The Service
Pingstack provides monitoring and operational tooling, including monitoring for websites, scheduled jobs, DNS records, TCP services, domains, SSL certificates, and heartbeats; dashboards and status pages; incident history; alerts; APIs; MCP; webhooks; and third-party integrations.
Pingstack reports observations and attempts to deliver notifications. The Service is not a guarantee that every check, alert, delivery channel, integration, or status-page update will be uninterrupted, timely, complete, or error-free. You remain responsible for selecting appropriate checks, thresholds, recipients, escalation paths, credentials, and independent verification.
2. Eligibility and Accounts
You must provide accurate account information, keep it current, protect your credentials, and promptly report unauthorized access. You are responsible for activity under your account and for actions taken by members of your workspace.
You may use Pingstack only if you have authority to monitor or administer the systems, domains, services, and data that you configure. Pingstack is intended for business and technical users and is not directed to children under 13.
3. Customer Responsibilities
You are responsible for:
- obtaining permission to monitor every host, domain, endpoint, network service, job, or system you configure;
- providing accurate URLs, schedules, thresholds, credentials, recipients, webhook destinations, and integration settings;
- protecting API keys, passkeys, tokens, webhook secrets, and other credentials;
- ensuring that workspace members and alert recipients are authorized to receive the information sent to them; and
- maintaining independent backups and incident-response procedures for critical systems and data.
You must not use Pingstack to scan, probe, access, disrupt, or send traffic to systems without authorization.
4. Acceptable Use
You may not:
- violate law, regulation, third-party rights, or an applicable contract;
- interfere with the Service, bypass limits, or attempt unauthorized access;
- probe or monitor systems without authorization;
- introduce malware or harmful code or use Pingstack to facilitate abuse;
- submit content that infringes rights, exposes unnecessary sensitive data, or violates privacy;
- abuse notification channels, webhooks, APIs, MCP, or integrations;
- reverse engineer or extract the Service except where applicable law permits; or
- use automated access in a way that creates unreasonable load or circumvents documented limits.
We may investigate suspected violations and suspend or restrict access when reasonably necessary to protect the Service, users, third parties, or security.
5. Customer Content
You retain your rights in content and configuration that you submit to Pingstack. You grant Atomic Van a nonexclusive, worldwide, limited license to host, process, reproduce, transmit, modify for technical reasons, and display that content only as needed to provide, secure, troubleshoot, and improve the Service or as instructed by you.
You represent that you have the rights and permissions needed for Atomic Van and its service providers to process Customer Content for those purposes.
Atomic Van may create aggregated or deidentified information that does not identify you or another person and use it to operate and improve the Service, subject to the Privacy Policy and applicable law.
6. Third-Party Services
Pingstack may connect to services that you select, including notification, ticketing, automation, payment, hosting, identity, and communications providers. Those services are governed by their own terms and privacy policies. Atomic Van is not responsible for third-party services, their availability, their changes, or their handling of information after a customer-authorized transfer.
7. SMS and Voice Alerts
Program. Pingstack Alerts sends text messages (SMS) and automated voice calls that notify you about incidents, recoveries, and other events for the checks your workspace monitors. Pingstack does not send marketing or promotional messages by SMS or voice call.
Consent. You consent to receive SMS or voice alerts by entering your mobile phone number in your Pingstack profile settings and turning on SMS or voice call alerts. You may enter only a phone number that you own or are authorized to use. Consent to receive SMS or voice alerts is not a condition of any purchase.
Message frequency and cost. Message frequency varies with the checks, rosters, and notification groups configured for your workspace. Message and data rates may apply. SMS and voice alerts on paid plans use the credits described on the pricing page.
Opting out and help. Reply STOP to any Pingstack text message to stop receiving SMS alerts; we will send one message confirming that you have been unsubscribed. You may also turn off SMS or voice call alerts, or remove your phone number, in your Pingstack profile settings at any time. Reply HELP for help, or contact support@pingstack.io.
Delivery. Mobile carriers are not liable for delayed or undelivered messages. SMS and voice delivery depends on carriers and communications providers outside our control, so you should not rely on SMS or voice as your only alert channel.
Privacy. Our Privacy Policy explains how we handle phone numbers and SMS consent. We do not sell or share mobile phone numbers or SMS opt-in data with third parties for their marketing purposes.
8. Fees and Subscriptions
Paid plans, prices, billing cycles, trials, usage limits, taxes, renewals, cancellation, refunds, and promotional terms are described on the applicable pricing page, checkout page, order form, or subscription agreement.
Unless a written order or checkout states otherwise:
- subscriptions renew for the same billing period until canceled;
- you authorize the applicable payment provider to charge fees, taxes, and other amounts due;
- cancellation takes effect at the end of the current paid period;
- fees already paid are nonrefundable except where required by law or expressly stated at checkout; and
- we may suspend access for overdue amounts after reasonable notice.
We may change prices for a future billing period by providing notice through the Service or to the account contact.
9. Intellectual Property
Atomic Van and its licensors own the Service, software, documentation, branding, and related materials, excluding Customer Content and third-party materials. These Terms grant only the rights expressly stated. You may use the Service and documentation for their intended purpose and may not copy, resell, frame, or commercially exploit them outside the permissions provided.
Pingstack names, logos, and branding are trademarks or trade dress of Atomic Van or its licensors. No trademark license is granted by implication.
10. Privacy and Data Processing
The Pingstack Privacy Policy describes how Atomic Van processes personal information.
When Atomic Van processes personal data submitted by a customer solely on that customer’s instructions, the customer is responsible for providing required notices and having a lawful basis. The parties will enter into a Data Processing Agreement where required by applicable law or contract.
11. Availability and Support
We may modify, improve, suspend, or discontinue features, integrations, plans, or parts of the Service. We may perform scheduled or emergency maintenance. We may limit or suspend access to address security, abuse, legal, payment, or operational issues.
Unless a separate written agreement states otherwise, the Service is provided without an uptime guarantee, response-time commitment, or service-credit obligation.
12. Suspension and Termination
You may stop using the Service and request account closure through available account controls or by contacting support@pingstack.io.
We may suspend or terminate access for material breach, nonpayment, abuse, security risk, legal obligation, or discontinuation of the Service. On termination, access ends and we may delete or deidentify Customer Content according to the Privacy Policy, applicable agreement, backup lifecycle, and legal obligations.
Unless a separate agreement provides otherwise, you should export information you need before termination. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual property, disclaimers, liability limits, indemnification, and dispute terms.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” ATOMIC VAN DISCLAIMS WARRANTIES NOT EXPRESSLY STATED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Pingstack is a monitoring and notification tool, not a replacement for customer-operated incident response, backups, security controls, or independent verification. We do not warrant that monitoring or alerts will detect every failure or arrive without delay.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOMIC VAN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOMIC VAN’S TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO ATOMIC VAN FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.
These limitations do not apply to liability that cannot lawfully be limited or excluded.
15. Indemnification
To the extent permitted by law, you will defend and indemnify Atomic Van, its affiliates, and their officers, employees, and agents against claims, losses, liabilities, and expenses arising from your unlawful use of the Service, your violation of these Terms, your Customer Content, or your infringement of a third party’s rights.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, excluding its conflict-of-law rules.
Before filing a legal action, the parties will try in good faith for 30 days to resolve the dispute by written notice to the other party. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Georgia, and each party consents to personal jurisdiction and venue in those courts.
Nothing in these Terms prevents either party from seeking temporary or preliminary injunctive relief, filing a claim in small claims court where available, or exercising a non-waivable right under applicable consumer law.
17. Changes to These Terms
We may update these Terms when the Service, our business, or applicable law changes. We will post the updated Terms and change the effective date. For material changes, we will provide additional notice where required by law. Your continued use of the Service after the effective date of an update means that you accept the updated Terms to the extent permitted by law.
18. General
These Terms, the Privacy Policy, and any applicable order form or Data Processing Agreement are the entire agreement concerning the Service, subject to any order-of-precedence terms in the applicable contract. If a provision is unenforceable, the remaining provisions remain in effect. Neither party may assign the agreement except as permitted by these Terms, applicable contract, or law.
